FileWorks collects certain personal information from Account Owners on its websites. Users must provide certain contact and account information including but not limited to name, email address, billing address, and phone number in order to create and use an account. FileWorks may use certain account information such as credit card number and company information of authorized users to conduct credit inquiries. FileWorks uses this information for internal purposes (to process your order and any invoices, to maintain or update your account, or to contact you about special offers, new services, special promotions, and noteworthy news and events).
FileWorks reserves the right to list Your company or organization name on published (print and digital) client lists. To exclude Your company's or organization's name from published client lists, the Account Owner must send an email request to Service@FileWorks.com. The email must be sent from the Account Owner using the email account that is associated with an account provided by FileWorks and must indicate that the company or organization name should not be included in published client lists. The company or organization name will be removed from media at the next print run or digital edition.
If you use our referral service for informing a friend about our site, we will ask you for the friend's name and email address. FileWorks will send your friend an email inviting him or her to visit a FileWorks-owned site.
Your profile information in the registration form is used by FileWorks to create personalized content, services, and advertising on its websites. FileWorks may also profile your website activity in order to accurately track your account and provide you with products and services that correspond to your interests. FileWorks may also compile data in aggregate form so that we may better understand the users that are visiting our sites. Aggregate data is anonymous and does not contain any personal information that identifies a user.
FileWorks will not monitor, edit, or disclose the contents of a user's private communications unless FileWorks and/or its contractors in good faith believe that such action is necessary to: (1) conform to the edicts of the law or comply with legal process served on FileWorks and/or its contractors; (2) protect and defend the rights or property of FileWorks and/or its contractors; or (3) act under exigent circumstances to protect the personal safety of its users or the public. Users should also be aware (and hereby agree) that certain technical processing of and access to fax messages and their content may be required to: (a) route the messages; (b) conform to connecting networks' technical requirements; (c) prevent or minimize disruptions to FileWorks' or its contractors' services; or (d) conform to other similar requirements.
FileWorks uses SSL encryption technologies to transmit sensitive information, such as a credit card numbers, to our servers. However, perfect security on the Internet does not exist, and FileWorks does not warrant that its websites are impenetrable or invulnerable to hackers. FileWorks has a number of operational functions in place to protect the confidentiality of personal information.
In addition, "cookies" (i.e., small text files placed on your computer when you first visit the site) are used on some of our websites. Most browsers now recognize when a cookie is offered and permit you to refuse or accept it. If you subscribe to newsletters from FileWorks, we may be able to confirm the email addresses of subscribers who have clicked on URLs embedded in our message content; we collect this information to gauge user interest and to make future newsletters more useful by customizing the content provided to you.
The personal information you provide to us will be retained only for as long as necessary to fulfill the purposes for which the information was collected or as required by law. We do not share personal information with third parties except as necessary to carry out our business, as required by law or other legal processes, or in the good-faith belief that such action is necessary in order to conform to the edicts of the law or to comply with a legal process served on our websites. FileWorks does not sell or rent information about its customers to third parties. Furthermore, personal data collected by FileWorks may be transferred to other member firms of FileWorks where it is necessary to meet the purpose for which you have submitted the information. Third-parties are required to maintain the confidentiality of your information and are prohibited from using that information for any other purpose. By submitting data through FileWorks electronically, you are providing explicit consent to trans-border transmission of data collected via FileWorks' Web sites.
In addition, FileWorks has technological and operational security policies and procedures in place to protect your personally identifiable information from loss, misuse, alteration, or unintentional destruction. Our personnel who have access to the data have been trained to maintain the confidentiality of such information.
Civil Subpoena Policy
FileWorks and its contractors do not release personally identifying information about our customers except in limited instances related to law, security, or safety. To request customer information in a civil case, you must serve FileWorks and its contracts with a valid subpoena, court order, or search warrant and agree to the company's terms of compensation below.

Upon receipt of a valid subpoena, it is FileWorks' and its contractors' policy to notify the subscriber whose information is sought. In non-emergency circumstances, FileWorks will generally not produce the subpoenaed subscriber's identity information until approximately two weeks after receipt of the subpoena, unless a formal objection is filed by the customer or we are legally required to do so.
FileWorks and its contractors charge $225.00 per hour for research (plus additional fees if testimony or deposition is required), $0.25 per page, and $35.00 to respond via FedEx. We will invoice the person or entity submitting the subpoena following receipt and the subpoena proponent must make payment within 15 days from the date of receipt of our invoice. Checks should be made out to FileWorks, Inc.
FileWorks understands the importance of protecting children's privacy, especially in an online environment. Our sites are not intentionally designed for or directed at children under the age of 18 years. It is our policy never to knowingly collect or maintain information about anyone under the age of 18.
